1 Our Community Mission
Cryzstl is built to provide content creators, video producers, and viewers with a safe, creative, and engaging streaming home. To foster an environment where everyone can freely share and enjoy video media, all members of our community must adhere to these Safety and Community Guidelines.
These guidelines apply across all areas of the Platform, including uploaded video streams, video titles and descriptions, channel custom designs, live comments, user profiles, and private messages.
2 Harassment, Hate Speech & Cyberbullying
We have zero tolerance for abusive behavior or targeted attacks. The following conduct is strictly prohibited:
- Hate Speech: Attacking, dehumanizing, inciting violence against, or promoting hatred against individuals or groups based on race, ethnicity, nationality, religion, sexual orientation, disability, veteran status, or gender identity.
- Harassment & Stalking: Sustained malicious targeting, repeated unwanted contact, insults, doxxing (publishing private personal information without consent), or inciting others to harass a creator or viewer.
- Threats of Harm: Explicit or implied threats of physical violence, swatting threats, or encouraging others to commit violent acts.
3 Child Safety & Absolute Zero-Tolerance Policy (CSAM/CSAE)
Zero Tolerance: Child Exploitation (CSAM/CSAE)
Cryzstl maintains an absolute zero-tolerance policy regarding Child Sexual Abuse Material (CSAM) or Child Sexual Exploitation and Abuse (CSAE) in any form.
Any account found uploading, linking, distributing, possessing, or facilitating access to such material is subjected to instant permanent termination without grace periods or notice. All associated digital footprints, IP hashes, and evidence are immediately preserved and referred to the National Center for Missing & Exploited Children (NCMEC) and relevant criminal law enforcement agencies.
4 Animal Abuse & Cruelty: Absolute Zero-Tolerance Policy
Zero Tolerance: Animal Cruelty & Abuse (Mandatory Criminal Referral)
Cryzstl enforces a strict, unconditional zero-tolerance policy against any form of animal cruelty, animal fighting, abuse, torture, or neglect.
Prohibited material includes, without limitation: staged animal fights (such as dogfighting or cockfighting), physical torture, beating, burning, intentional starvation or dehydration, bestiality, animal crush content, wildlife harassment, or filming animal distress for sensationalism or profit.
Criminal Referral Notice: Any account uploading, distributing, or promoting animal cruelty will be subjected to instant permanent termination without any grace period. All account telemetry, IP logs, registered credentials, and uploaded video files will be immediately frozen and proactively transmitted to local law enforcement, municipal animal control authorities, and state/federal prosecutors for criminal prosecution under applicable animal protection and felony cruelty laws.
5 Sexual Content & Adult Link Aggregators (Absolute Zero Tolerance)
Cryzstl is a dedicated general-audience media platform. We do not allow pornography, sexually explicit videos, erotic performances, or adult services of any kind.
Direct & Indirect Adult Promotion Prohibitions
The following content and activities are strictly prohibited across video streams, thumbnails, channel banners, avatars, profile biographies, video descriptions, and comments:
- Pornography, explicit sexual acts, fetish depictions, or genital/breast nudity.
- Solicitation of commercial sex work, escort services, or adult webcam broadcasts.
- Direct Off-Site Adult Links: Hyperlinks pointing directly to adult subscription networks, paywalls, or adult creator platforms (including OnlyFans, Fansly, LoyalFans, ManyVids, Chaturbate, Pornhub, or similar portals).
- Off-Site Funneling via Link Aggregators: Using "link-in-bio" or multi-link aggregator tools (including Linktree (linktr.ee), Beacons (beacons.ai), Bio.link, Carrd, Campsite, AllMyLinks, or custom landing pages) to route, promote, or redirect viewers to sexually explicit material or adult subscription hubs.
6 Violent, Graphic & Dangerous Content
We prohibit content that promotes, glorifies, or depicts dangerous or illegal behaviors:
- Graphic Violence & Gore: Gratuitous real-world violence, bodily mutilation, severe physical trauma, or gore uploaded for sadistic or shocking purposes.
- Self-Harm & Suicide: Content encouraging, depicting, or providing instructional material for suicide or deliberate self-harm. If you or someone you know is struggling, help is available via national crisis hotlines (988 in the US/Canada).
- Dangerous Activities: Encouraging dangerous stunts or illegal acts that pose high risk of severe physical injury, property destruction, or death.
7 Spam, Scams & Deceptive Metadata
Honest engagement keeps our platform thriving. Content creators must ensure:
- Accurate Metadata: Video titles, tags, and thumbnails must genuinely reflect the contents of the video. Deceptive clickbait designed to distribute malware, phishing links, or financial scams is strictly prohibited.
- No Fake Engagement: Artificial manipulation of views, likes, or subscriber counts through bots, click farms, or automated reloaders will trigger automated strike escalation and channel suspension.
- Spam Comments: Commercial link spam, bulk repetitive messaging, or fraudulent giveaway schemes in comments will be automatically quarantined by our spam defense engine.
8 Copyright Respect, Fair Use & Intellectual Property
Cryzstl is dedicated to supporting creative expression while rigorously protecting intellectual property rights. Creators should only upload video content, music, and artwork that they have created themselves or have obtained lawful authorization to use.
Understanding the Fair Use Doctrine (17 U.S.C. § 107)
Under United States copyright law (17 U.S.C. § 107), the doctrine of Fair Use permits creators to use copyrighted material without permission from the copyright owner under certain specific circumstances. Fair use exists to foster public debate, creativity, education, and free speech.
The Four Statutory Fair Use Factors
Fair use is not an automatic right; it is an affirmative legal defense assessed on a case-by-case basis by weighing four statutory factors:
Is the work transformative? Has the copyrighted material been adapted by adding new expression, commentary, criticism, or message? Transformative works (such as reviews, critiques, and parodies) are far more likely to qualify as fair use than verbatim copies.
Borrowing excerpts from factual, historical, or news works is much more likely to be considered fair than using creative, fictional, or artistic works (such as feature films, studio music tracks, or fictional scripts).
Using small, brief excerpts tailored specifically to support your critique or educational point is more likely fair than using large portions. Using the “heart” of the work (the most memorable riff or climactic scene) weighs heavily against fair use.
Does your video serve as a market substitute for the original work, depriving the copyright holder of sales or streaming revenue? If viewers watch your video instead of the original, it strongly weighs against fair use.
Generally Acceptable Fair Uses
- Criticism & Film/Game Reviews: Using short video clips or stills to critique, analyze, or review movies, games, or television.
- Parody & Satire: Transforming the original work humorously to critique or comment upon the work itself.
- News Reporting & Current Affairs: Brief broadcast snippets used directly to inform the public regarding breaking news or societal events.
- Teaching & Educational Analysis: Video essays, academic demonstrations, and instructional explainers dissecting techniques.
- Transformative Commentary: Active, substantive reaction where you pause, critique, discuss, and add significant new insight (not passive re-broadcasting).
Common Myths & What Is NOT Fair Use
- “Credit to the Owner”: Giving credit or attribution in the description does not create fair use or grant copyright rights.
- “No Infringement Intended”: Legal disclaimer templates in descriptions provide zero legal protection against infringement.
- “I'm Not Making Money”: Non-profit or unmonetized status does not automatically make an unauthorized upload fair use.
- The Mythical “30-Second Rule”: There is no specific number of seconds legally allowed. Even a 5-second sample can infringe if it takes the melodic heart.
- Passive Unedited Streaming: Streaming full episodes, entire songs, or background music with minimal host reaction is copyright infringement.
If your video is subjected to a DMCA takedown notice and you firmly believe your use qualifies as lawful Fair Use, you have the statutory right to submit a formal DMCA Counter-Notification pursuant to 17 U.S.C. § 512(g). Detailed counter-notice procedures and requirements are set forth in our Terms of Service.
9 Enforcement Ladder & Penalties
When violations occur, our moderation team evaluates severity, intent, and previous account history. Enforcement measures include:
First-time or minor infraction. Offending content removed; educational notice issued.
Temporary restriction on video uploading, commenting, or channel editing for 7–14 days.
Full account suspension. Channel unlisted and access to dashboard revoked for up to 30 days.
Instant, permanent account purge with no grace period for CSAM, Animal Abuse, or Adult Content / Link Funneling. Future registrations blocked.
10 Reporting Violations & Appeals
If you encounter content or behavior that violates these Community Guidelines, please use the on-page reporting flag on the video player or channel profile. All reports are reviewed by human safety specialists.
If you believe an enforcement action was taken against your account in error, you may submit a formal moderation appeal by contacting moderation@shiningashes.net with your username, case reference ID, and relevant context.
